Terms & Conditions & Cancellation Policy
1. APPLICATION
These General Terms and Conditions of Sale (hereinafter referred to as "GTCS") apply to sales made by the Hotel (hereinafter referred to as "the Company") to the Customer.
They cancel and replace any previous version that may have been posted online and/or accepted by the Customer.
These GTC apply to all use of the Sites, which are available at the following address
- https://rivesdenotredame.com/ (hereinafter "the Site"), in particular to the marketing, by Internet and telephone, of all the services offered on the Site by L'Hôtel Les Rives de Notre Dame.
It is therefore essential that the Customer carefully read the GTC, which are referenced by a hypertext link on each page of the Site. In particular, the Customer is advised to download and/or print them on the day of his/her order, in order to keep a copy, subject to modification. However, it is stipulated that these modifications will not apply to orders for Services placed previously.
The GTCS may be supplemented by specific terms and conditions of sale contained in the description of the service, as well as by the terms and conditions of sale of the service providers, which may be accessed either on their Internet Site or on site.
2. CONDITIONS OF ACCESS TO THE SITE
Access to the Site is free to any user with Internet access. All costs relating to access, whether hardware, software or Internet access costs, are borne exclusively by the user.
The Company shall not be liable for the proper functioning of the user's computer equipment or Internet access.
The Site is accessible 24 hours a day, 7 days a week.
Due to the nature and complexity of the Internet network, and in particular its technical performance and response times for consulting, querying or transferring information data, the Company makes its best efforts, in accordance with the rules of the art, to allow access to and use of the Site and the services offered. The Company cannot guarantee absolute accessibility or availability of the Site.
In particular, the Company reserves the right, without prior notice or compensation, to temporarily close the Site or access to one or more services, in particular to carry out updates, maintenance operations, modifications or changes to operating methods, servers and access times, without this list being exhaustive.
The Company reserves the right to add to or modify the Site and the services available on it at any time in line with technological developments.
It is the user's responsibility to ensure that the IT and transmission resources at his/her disposal are able to adapt to changes in the Site.
3. CAPACITY
The Customer acknowledges that he/she has the capacity to enter into a contract, i.e. that he/she is an adult within the meaning of the law and is not under curatorship or guardianship.
The Customer also declares that he/she will use the Site in accordance with these GCS, in his/her own name and on behalf of all the beneficiaries of the services ordered by him/her on the Site, of whom he/she acknowledges being the representative (hereinafter the "Beneficiaries") and to whom these GCS will be enforceable.
The Customer is financially responsible for the use of the Site made both in his own name and on behalf of the Beneficiaries, unless he can demonstrate fraudulent use that is not the result of any fault or negligence on his part.
The Client guarantees the truthfulness and accuracy of the information it provides in its own name and on behalf of all the Beneficiaries using its data on the Site.
The Company reserves the right at any time not to enter into a contract with a Client who is making fraudulent use of the Site or who is in breach of these GCS.
The terms of article 313-1 of the French Criminal Code are recalled in this respect:
"Fraud is the act, either through the use of a false name or capacity, or through the abuse of a true capacity, or through the use of fraudulent manoeuvres, of deceiving a natural or legal person and thus determining, to his detriment or to the detriment of a third party, to hand over funds, securities or any other property whatsoever, to provide a service or to agree to an act creating an obligation or discharge.
Fraud is punishable by five years' imprisonment and a fine of 375,000 euros.
4. ACCOMMODATION
Rooms will be available from 3 p.m. on the day of arrival until 12 a.m. on the day of departure, after which an additional night will be charged to the Customer.
The rates, terms and conditions of reservation are intended for the sale of hotel rooms in accordance with their main purpose: accommodation. The hotel reserves the right to modify or cancel the reservation(s), rates and conditions if the rooms are used for purposes other than accommodation such as parties, dinners, meetings, photo or video shoots, film shoots or interviews, written or filmed, whether or not intended for social networks, or any other publication, showrooms, etc. (non-exhaustive list) without prior written authorisation from the hotel's general manager.
The number of people in the rooms may not exceed the number of people booked and the maximum capacity of the rooms declared to the Préfecture de Police de Paris (declaration available from the hotel management).
5. NO RIGHT OF WITHDRAWAL
Article L.221-28 12 of the French Consumer Code states: "The right of withdrawal may not be exercised for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, car hire, catering or leisure activities which must be provided on a specific date or during a specific period". This means that the consumer does not have the right of withdrawal.
6. PRICES
Prices are quoted in euros. VAT is included in the prices quoted. Any change in the applicable rate, or any change or introduction of new official taxes established by the competent authorities, is automatically reflected in the prices quoted on the date of invoicing.
Prices are per room, for the number of people indicated and according to the period chosen.
The prices indicated include only the services specifically mentioned in the reservation. The price mentioned in the reservation is increased by the price of additional services provided by the hotel at the time of the stay and, where applicable, the tourist tax.
The prices mentioned on the Site are subject to change at any time by the Hotel without notice. Only the price indicated in the Company's reservation confirmation is contractual.
7. ONLINE ORDERS
When placing an order, the Customer must :
- fill in the identification form with all the contact details requested or give their customer number if they have one,
- complete the online order form and indicate all the references of the products or services chosen,
- confirm their order after checking it,
- make payment in accordance with the conditions stipulated and confirm their order and payment if they have opted for a prepayment plan, or send the Company their bank details if they have opted for a flexible plan.
Any reservation of 3 rooms or more is considered to be a group reservation and may entail special conditions and specific additional charges.
Confirmation of the order implies acceptance of these terms and conditions of sale, full knowledge of them and waiver by the customer of his or her own purchasing or other conditions.
All the data supplied and the recorded confirmation are proof of the transaction, and the confirmation is deemed to be the signature and acceptance of the operations carried out.
The Company will send the Customer confirmation of the recorded order by any means (e-mail, post, etc.).
The reservation is firm and definitive only after the Client has received the confirmation sent by the Company.
The hotel reserves the right to cancel reservations if the Client does not comply with the sales conditions requested.
Please note that the photos on our Site are for illustrative purposes only and are not contractually binding.
8. ONLINE PAYMENT CONDITIONS
Depending on the type of reservation made, the price is due in full at the time of the order (prepayment or "hot deal" type plan) or at the end of the Customer's stay at the Hotel.
In all cases and in order to guarantee their reservation, the Customer is asked to provide their credit card number, which will be transmitted by secure means.
If payment is made when the order is placed, the credit card information transmitted by the Customer to the Company via a secure system will enable the Company to debit the card for the total amount of the stay, again in a secure manner. The Customer's credit card will be debited on the day the order is placed; the invoice will be sent by the Company to the Customer on the day the Customer leaves the Hotel.
Please note that the credit card used to make the reservation must be presented at check-in, together with valid identification. The name of the credit card holder must match the name of the Guest, otherwise a new credit card will be requested for full payment on arrival.
Please note that the hotel will pre-authorise your credit card to ensure, amongst other things, that sufficient funds are available to cover the cost of your stay at any time prior to arrival.
9. MODIFYING OR CANCELLING A RESERVATION
Reservation cancellations and/or modifications may be authorised in accordance with the rate plan chosen by the Customer.
The Hotel offers a number of rate plans, including flexible, semi-flexible and non-refundable rates. Each of these rate plans is subject to separate cancellation conditions, as indicated at the time of booking. Please note that cancellation conditions may vary depending on the rate plan chosen at the time of booking.
Guests are encouraged to inform the hotel of their intention to cancel their booking as soon as possible. The period of notice required for cancellation may vary depending on the season of the year and the rate plan chosen. It is recommended to contact the hotel directly for specific information on the cancellation period applicable to your booking.
Refunds of payments made in the event of cancellation will depend on the cancellation policy associated with the price plan chosen at the time of booking.
If the Customer opts for a non-refundable prepayment or advance purchase plan, no changes or cancellations will be accepted, the total amount of the stay will be retained by the Hotel and the Customer will not be entitled to request a refund or deferral of credit.

Additional charges may apply depending on the changes made to your reservation, in accordance with the conditions of the rate plan chosen.
the date of receipt - Paris time - of the request for modification and/or cancellation (by e-mail, post or telephone) is the cancellation date.
The modification and/or cancellation of a reservation is firm and definitive only after receipt of an e-mail confirmation from the Hotel.
If the Customer does not come to the Hotel, and in the absence of a cancellation :
- The full amount of the reservation will be retained by the Hotel in the case of a prepayment or "hot deal" reservation.
- The first night will be charged by the Hotel in the case of a "Flexible Plan" reservation.
- In addition, for a stay of at least 2 nights, if the Customer does not arrive at the Hotel on the first day of the stay, the Hotel will not be obliged to keep the room available for the Customer for the remainder of the stay.
The Client is asked to plan to arrive at the Hotel before 6 p.m. on the day of check-in and to inform the Hotel in the event of a late arrival, failing which he/she may be deemed not to have checked in on the first day of his/her stay.
In the event of early departure, the entire stay will be charged.
10. TRANSFER OF THE CUSTOMER TO ANOTHER HOTEL
In the event that the Hotel is not available or in the event of force majeure, the Hotel reserves the right to have the Customer stay, for all or part of the duration of the stay, in a hotel of equivalent or higher category, offering services of the same type. In this case, the transfer is at the expense of the Hotel, which may not be sought or called upon to pay any additional indemnity or compensation.
11. ANCILLARY SERVICES - PACKAGES
Orders for ancillary services and/or packages may only be placed at the same time as a reservation for a stay at the Hotel on a given, predetermined date.
They may only be used by the Client during his/her stay at the Hotel and may only be modified and/or cancelled under the conditions defined in article 8 of this document.
12. FORCE MAJEURE
Force majeure is defined as any event that is not related to the parties and that is both unforeseeable and insurmountable, preventing either the Client or the Hotel Owner from performing all or part of the obligations contained in the contract.
It is expressly agreed that a situation of force majeure suspends the performance by the parties of their reciprocal obligations and that each party will be required to pay the costs arising therefrom.
Customers alone shall bear any additional expenses that may be incurred to enable their journey to continue, following the occurrence of a situation of force majeure.
13. COMPLAINTS
Any complaint must be sent to the following address: HOTEL LES RIVES DE NOTRE DAME - 15 QUAI SAINT MICHEL - 75005 PARIS - FRANCE, within a maximum period of 15 days following the end of the holiday that is the subject of the complaint. After this period, no complaint may be examined or taken into account.
14. WI-FI NETWORK ACCESS POLICY
The company offers Wi-Fi Internet access. The Customer undertakes to ensure that the computer resources made available to him/her are not used in any way for the purposes of :
- reproducing, representing, making available or communicating to the public works or objects protected by copyright or related rights, such as texts, photographic images, audiovisual musical works, software and video games, without the authorisation of the holders of the rights indicated in Books I and II of the Intellectual Property Code if such authorisation is required.
- which may be prejudicial to the Hotel.
- which may threaten the security of the establishment.
15. LIABILITY
The Company may exercise its right to refuse, for legitimate reasons, the deposit of objects belonging to the Customer during his/her stay. It shall justify this refusal to the Customer.
In the event of theft or damage to objects of any kind belonging to the Client, and except in the event that these objects have been deposited with the Company or objects whose deposit has been refused by the Company without legitimate reason, the Company's liability is limited in accordance with the provisions of article 1953 of the French Civil Code.
The Client will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of the occupation of the premises and/or as a result of the act or fault of the participants and/or staff for whom the Client is responsible, to movable property, decorations and immovable property, whether or not it belongs to the hotel. Consequently, the Company is fully entitled to ask the Client to leave the hotel without compensation and without reimbursement of the current stay, and to reimburse the damage caused by these acts.
In the online sales process, the Company is bound only by a best-efforts obligation and may not be held liable for any damage resulting from use of the Internet, such as loss of data, intrusion, viruses, interruption of service or any other related and involuntary problems.
16. DATA PROTECTION
As the data controller, the Hotel processes customer data for the following purposes:
- taking action at the request of the data subject before entering into a contract,
- to provide services,
- to manage its customers' reservations and stays,
- to manage relations with its partners,
- to manage contracts concluded with data subjects,
- manage its activities,
- manage its websites,
- measure the quality and satisfaction of its customers,
- ensure customer satisfaction,
- continually improve the quality of its products and services,
- improve knowledge of its customers,
- compile statistics.

17. OPPOSITION TO TELEPHONE CANVASSING
Customers who do not wish to receive commercial canvassing by telephone are informed that they have the right to oppose telephone canvassing by entering their landline and/or mobile telephone numbers on the free opposition list accessible via the www.bloctel.gouv.fr website .

18. INTELLECTUAL PROPERTY
These terms and conditions do not imply any transfer of property rights of any kind, in particular intellectual property rights, to the elements belonging to the Company for the benefit of the Client, who shall in any event refrain from taking any action or performing any act likely to infringe, directly or indirectly, the Company's intellectual property rights.
In this respect, it is specified that the content of the Site, the general structure as well as the trademarks, drawings, models, images, whether animated or not, texts, photographs, logos, graphic charters, software and programmes, search engines, databases, sounds, videos, domain names, design and all the other elements making up the Site or any other information appearing on it, without this list being exhaustive, are the exclusive property of the Company or of partners or third parties who have granted it a licence, and are protected by intellectual property rights which are or will be recognised to them according to the laws in force.
Any reproduction and/or representation, in whole or in part, of any of these elements, without the express authorisation of the Company, is prohibited and would constitute, in particular but not exclusively, an infringement punishable by the provisions of the Intellectual Property Code.
19. CONSUMER OMBUDSMAN
In the event of a dispute relating to these General Terms and Conditions of Sale, and only if the Customer is a consumer, the Customer shall be informed by the Hotel of the possibility of using the consumer mediation procedure under the conditions provided for in article L 616-1 of the Consumer Code.
After contacting the customer service department, and in the absence of a satisfactory response within 15 days, the customer may refer the matter to the Tourism and Travel Mediator, whose contact details are given below:

20. LANGUAGE
The French version of these General Terms and Conditions of Sale shall prevail over any other version available in another language.
21. APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law. The same applies to the rules of form and substance. The French courts have sole jurisdiction to hear any disputes.
22. DISPUTES
In the event of a dispute arising from the interpretation, performance or termination of these General Terms and Conditions of Sale, the competent court will be determined :
- if the Customer is a natural person, in accordance with the applicable legal provisions governing relations between a consumer on the one hand and a professional on the other,
- if the Customer is a legal entity, the courts of Paris shall have sole jurisdiction.
